By accessing, browsing, consulting, or commissioning engineering operations via Kelvin HVAC websites, interfaces, or direct professional contracts, you acknowledge that you have read, understood, and agreed to be legally bound by these comprehensive Terms of Use and our associated operational guidelines.
These terms apply universally to all residential developers, commercial building operators, industrial facilities managers, architects, and private clients who engage our HVAC design, thermal modeling, ductwork integration, ventilation balance, or maintenance curation services.
Engineering Scope, Climate Architecture and Advisory
All thermal load calculations, psychrometric analyses, airflow volume simulations, and HVAC equipment specifications prepared by Kelvin HVAC represent professional engineering recommendations based upon diagnostic site variables supplied by the client or verified during on-site inspections.
Technical Variance and Environmental Thresholds
Climate architecture systems depend upon rigorous structural insulation, building envelope integrity, and occupancy variables. Kelvin HVAC cannot guarantee uniform thermal equilibrium if the physical structural boundaries depart from documented architectural baselines.
All technical advisories published within our technical blog or online resources are provided for informative architectural reference and do not replace certified on-site mechanical calculations.
Proprietary Schematics, Blueprints and Intellectual Property
All proprietary mechanical designs, ventilation airflow diagrams, acoustic dampening methodologies, digital calculation models, custom CAD layouts, and written content remain the exclusive intellectual property of Kelvin HVAC and its engineering partners.
- Clients are granted a revocable, non-exclusive license to utilize engineering blueprints exclusively for the singular specified project address.
- Redistribution, commercial resale, public dissemination, or unauthorized reproduction of custom mechanical plans is strictly prohibited.
- All software algorithms and thermal assessment tools featured on our portal remain proprietary assets.
Client Obligations and On-Site Access Protocols
To guarantee safety and adherence to mechanical engineering codes, clients contracting our field technicians or installation specialists agree to fulfill the following prerequisites:
Unobstructed Access
Ensure safe, cleared entry to mechanical penthouses, basements, ceiling plenums, electrical disconnects, and ventilation shafts during agreed service windows.
Structural Disclosure
Provide accurate architectural drawings, hazardous material disclosures (including asbestos or lead), and known electrical schematics prior to system retrofits.
Equipment, Workmanship and Performance Standards
Mechanical units, compressors, chillers, heat pumps, air handlers, and filtration media deployed during installation are backed by their respective manufacturer warranties in addition to our certified workmanship guarantee.
Workmanship warranties require continuous operational compliance, including adhering to scheduled preventative maintenance intervals and employing authentic filtration media as specified in the mechanical commissioning logs.
Limitation of Direct and Consequential Liability
To the fullest extent permitted by applicable statutory law, Kelvin HVAC shall not be held liable for indirect, incidental, punitive, or consequential damages resulting from utility grid power surges, third-party structural modifications, abnormal weather anomalies beyond designated design parameters, or unauthorized equipment tampering.
In all events, the aggregate liability of Kelvin HVAC arising from any operational contract or digital engagement shall not exceed the total fees paid by the client for the specific mechanical service segment giving rise to the claim.
Billing, Engineering Rates and Engagement Termination
Invoices for engineering consultations, diagnostic assessments, scheduled maintenance contracts, and equipment retrofits are issued according to signed work authorizations. All charges are due pursuant to stated commercial payment terms.
Kelvin HVAC reserves the unilateral right to suspend active on-site mechanical operations or terminate ongoing service agreements should safety hazards remain unaddressed or contractual payment obligations enter default status.
Governing Law, Dispute Resolution and Inquiries
These Terms of Use and all related engineering agreements shall be governed by and interpreted in accordance with applicable state and federal commercial trade laws. Any disputes arising hereunder shall initially be submitted to structured mediation prior to formal judicial proceedings.
